1. Definitions
1.1.The Villa or the B&B, we, our, etc., will mean in the context of this contract B&B Pensiunea Valea Mare, operated by SC 3 MT Serv SRL.
1.2. The Tourist means every individual or company who books a travel service or package with our Villa.
1.3. Accommodation - means the whole period of your stay with us.
1.4. Support services means in the context of this contract, but not limited to: any supplimentary service, as meals, transportation, tickets to events, transfers, guided tours or day excursions.
1.5. Overbooking - In rare cases, we confirm more than our physical capacity of our Villa. In such cases, clause 2.2.1. applies.
1.6. Regular clients are clients who book a room or a package with us more than once a year.
1.7. Early birds are clients who book and pay their rooms or packages with at least 6 months in advance.
2. Our obligations
2.1.The Villa is responsible for the good performance of the accommodation services or support services negotiated with the Tourist, except when the performance is affected by the tourist or by any third party; or in case of force majeure, as defined by the Romanian legislation. The B&B can not be hold responsible for the method of classifying the accommodation outlets, the eating outlets or the transport facilities used in our connex services.
2.2. The B&B shall respond to any booking requests within 48 hours of their receipt, either confirming or infirming a booking.
2.2.1 In case of overbooking, the B&B shall be responsible for offering an accommodation at another B&B of similar or higher category.
2.3. Every support service (especially transfers to/from the airport, train station, etc.) is important to us, though we can not be hold responsible for any losses or supplementary charges resulting from timetable changes of the carriers or third parties to the contract, nor for the damages, losses, deteriorated goods, late runnings, accidents, etc., arisen from any third party's guilt. The B&B can, however, decide upon offering supplementary services to compensate for those incidents, provided the tourist regards them as well compensatory and does not have any further claims.
2.4. The rates can be changed without prior notice. Confirmed rates, given to guestes who have already booked a room with us, can not be changed.
2.5. The rate of accommodation or any independent arrangement that makes the object of the underlying contract, unless otherwise stated in a particular offer, includes the cost of the services and any VAT due, as well as other legal taxes. The price is published in our standard offer or is communicated directly to the tourist in the case of special arrangements.
3. Our Expectations from the Tourists
3.1. The Tourist is required to pay the full price for the accommodation at the latest by the time of check-in. Any supplementary services are to be paid at the latest by check-out.
3.2. The Tourist has the right to require the paid services, proved by the documents/voucher presented.
3.3. If problems occur during the programme, package or stay with us, the tourist is required to contact the group leader, or if there is no group leader available, the villa in order to point out these deficiencies before check-out. After check-out, any claims are not taken into consideration.
3.4. If the tourist cancels the booking following a cause which can not be imputed to the villa, the villa will charge the following penalties:-
3.4.1. between 14^th and 10^th day before the date of check-in, 25% of the price,
3.4.3. between the 10^th and the 1^st day before the date of check-in, 80% of the price will be retained.
3.4.4. In case of no show on the date of check-in, 100% of the price will be retained.
3.5. Indecent, immoral and illegal activities are not allowed in our Villa. If this clause is being respected, Pensiunea Valea Mare reserves the right, in extreme situations, to interrupt the accommodation at any hour. This may not result automatically in a compensation of unused stay in our villa. Any small issues shall be resolved in a friendly manner.
4. Promotions can not be cumulated, unless specifically stated.
5.This contract becomes enforceable on the date of signing or of accepting our services at the stipulated price and conditions over the telephone, in writing, or in person, in knowledge of this contract.
6. Any claims, will be solved in a friendly manner; otherwise, it is open to court judgement. This contract falls exclusively under Romanian law.
